Evidence - “Reasonable Degree” of Certainty
Griffin v. University of Pittsburgh Medical Center, Pa. Super. Court, opinion by Bender, J., filed May 19, 2008 (PICS No. 08-0843).
In reversing a jury verdict for a plaintiff, the Superior Court panel held that even if a medical expert testified that his or her opinion was based upon a reasonable degree of medical certainty, where the expert, in fact, testified that there were two possible causes, both of which were almost equally likely to have created the injury, a verdict based on that testimony will not stand. |
