Re: DeWeese v. Weaver

In DeWeese v. Weaver, 2005 WL 1719711 (Pa.Cmwlth., July 26, 2005) (No. 567 M.D. 2002) the Commonwealth Court holds that the Fair Share Act is "unconstitutional and void" under the State Constitution's single subject rule. The Bill that amended the Judicial Code chapter relating to comparative negligence also codified the DNA Act. The Court found that requiring DNA samples from incarcerated felony sex offenders did not bear a proper relation to joint and several liability for acts of negligence and, therefore, the Bill violated the single subject rule.
